Overview
Michael S. Goldenberg is a partner in the firm’s New York and New Jersey offices. Michael’s practice is devoted to representing corporate and individual clients in lawsuits involving catastrophic personal injury, construction accidents and Labor Law claims, premises liability, product liability, and property damage through all phases of litigation including trial. Michael is regularly retained by primary and excess insurers to perform risk and exposure analysis. He has earned a reputation among his clients for his preparedness and ability to efficiently handle matters involving complicated liability and damages issues. Michael applies unconventional approaches to his case handling so that matters are well positioned for dispositive motion practice and/or trial. Recognizing that relationships are key to leveraging successful outcomes, Michael has earned the trust and respect of his adversaries, fostering environments where parties can candidly discuss their position, often resulting in equitable resolution.
In the context of Labor Law and construction claims, Michael regularly represents property owners and contractors involved in demolition, excavation, steam-fitting, electrical and plumbing activities. His experience also includes representing a kitchen appliance manufacturer in lawsuits brought by multiple families for second and third degree burns, representation of a propane distributor in a lawsuit by a customer for burns suffered in connection with an explosion, representation of large casino in connection with construction accident resulting in severe traumatic brain injury to a worker, defense of multiple property owners, general contractors and subcontractors in connection with labor law claims involving alleged violations of Section 240 and 241(6), representation of international shipping distributor in claim brought by injured warehouse worker for crush injury to foot from forklift accident implicating “special employee” defense, representation of premises owner in connection with shooting death of tenant, defense of multiple commercial fire suppression system contractors in multi-million dollar property damage lawsuits, and defense of premises liability lawsuit involving spinal cord and traumatic brain injury resulting from a fall down stairs.
In addition to his litigation experience, Michael regularly provides lectures and educational seminars to the insurance claims industry. His past presentations include addressing implications of the New York Labor Law on underwriting as well as presenting to an international delegation of insurance professionals regarding underlying factors influencing North American claims.
Michael is a former federal law clerk, having clerked for the Honorable Mark Falk, U.S.M.J in the United States District Court for the District of New Jersey.
